Resolution of personal and complex trust disputes
We have a broad experience in dealing with disputes that arise in relation to complex personal and family financial matters. This includes prosecuting or defending claims in breach of trust; duress and undue influence in relation to financial settlements. We have been consulted on some of the world’s largest divorces because of our experience in asset tracing and our understanding of complex trust structures. Our lawyers have in-depth knowledge of testamentary capacity and construction of testamentary documents, proprietary estoppel and the removal of trustees and probate claims.
Our lawyers have worked on many high-profile cases in England and in Jersey including forcing the removal of difficult trustees by Court Order and restoring trust assets lost as a result of the trustees’ conduct; successfully prosecuting a claim in fraud on behalf of off-shore trustees whist protecting the integrity and unanimity of the trust; defending a substantial claim on the trust assets on behalf of the off-shore professional trustee; acting for a number of wealthy individuals as they seek to unravel their assets following a relationship breakdown; and numerous cases for and against claimants under the 1975 Inheritance Act.
